ICC rejects Palestinian bid to investigate Israeli war crimes during Operation ‘Cast Lead’

The ICC in The Hague says reason for rejection is Palestine is currently recognized by the UN as an ‘observer,’ not a ‘Non-member State’.

 

The International Criminal Court prosecutor announced Tuesday that he has rejected a bid by the Palestinian Authority to have the war crimes tribunal investigate Israeli conduct during ‘Operation Cast Lead’ in Gaza.

Report: Obama to Abbas – Don’t charge Israel at the ICC

Arabic newspaper Asharq Al-Awsat reported that during the Ramallah talks US president urged Abbas to refrain from charging Israel at the int’l court in the Hague for any reason.

US President Barack Obama asked Palestinian President Mahmoud Abbas to refrain from taking Israel to the International Criminal Court in The Hague for any reason, the London-based Arabic newspaper Asharq Al-Awsat reported Saturday.

The newspaper quoted a Palestinian official as saying that during their meeting in Ramallah on Thursday Abbas told Obama he would wait two months before talking any measures against Israeli settlement construction, but stressed he would turn to the ICC immediately should the Jewish begin building in the E1 zone between Jerusalem and Ma’ale Adumim. UNHRC ready to discuss West Bank settlement report

UN Council to examine resolutions filed against Israel after their investigators concluded that Israel could be culpable before the International Criminal Court.

 

The United Nations Human Rights Council will on Monday debate a report by its fact-finding mission on West Bank settlements, which concluded that Israel could be culpable for building over the pre-1967 lines before the International Criminal Court, if the Palestinians become party to the Rome Statute.

Israel is moving forward with plans for two major settlement projects in east Jerusalem, a spokeswoman said Tuesday, even as a senior Palestinian official warned that his government could pursue war crimes charges if Israel does not halt such construction.

International anger over Israeli settlement construction has snowballed in recent days, following the UN’s decision to upgrade the Palestinian Authority’s status to that of a “nonmember state” last week.

PA will turn to ICC if evidence found that Arafat was murdered

The International Criminal Court on Tuesday rejected a Palestinian petition to prosecute Israel for alleged violations in the West Bank and Gaza because Palestine is not a full member state of the United Nations.

While pro-Israel advocates hailed the decision as a victory in the arena of “lawfare,” the Foreign Ministry in Jerusalem greeted it with a lukewarm response.

A few days after Operation Cast Lead, in early 2009, Palestinian Justice Minister Ali Khashan wrote to the International Criminal Cour asking it to investigate Israel’s conduct in the West Bank and Gaza.
